Terms and Conditions for Bend Barks and Rec Services
By booking a service with Bend Barks and Rec, LLC. You (the "Client") agrees to the following terms and conditions:
1. General Agreement
The Client agrees to release, indemnify, and hold harmless Bend Barks and Rec, its owners, employees, contractors, and agents from any and all liability for any injury, illness, or damage to the dog or other animals during the course of services rendered.
The Client acknowledges that all services provided by Bend Barks and Rec are at the Client’s own risk.
2. Health and Fitness of the Dog
The Client confirms that their dog has been checked by a licensed veterinarian and is in good health, capable of participating in exercise sessions, including but not limited to walking, running, and other physical activities.
The Client agrees that their dog is up to date on vaccinations, flea/tick prevention, and has no contagious diseases that could affect other dogs or individuals.
The Client agrees to inform Bend Barks and Rec of any medical conditions, behavior concerns, or health issues that may affect their dog’s participation in the services.
3. Veterinary Approval
By clicking "I have read and agree to the terms above" or proceeding with the booking, the Client agrees that their dog has received approval from a licensed veterinarian to engage in the physical activities provided by Bend Barks and Rec.
The Client will provide any necessary documentation or contact details for their veterinarian if requested by Bend Barks and Rec.
4. Liability Release
The Client understands that while Bend Barks and Rec will take all reasonable precautions to ensure the safety and well-being of their dog, there is always some inherent risk associated with physical exercise, including elevated heart rate, muscle strain, and other health factors. The Client acknowledges that accidents or injuries may occur during walks, runs, or other activities.
The Client agrees to hold Bend Barks and Rec harmless for any injuries, illnesses, damages, or losses to their dog, property, or any third parties resulting from the dog’s participation in the services.
5. Dog's Health and Responsibility
The Client takes full responsibility for their dog's health and well-being. The Client acknowledges and agrees that they are solely responsible for the dog’s fitness to participate in any activities provided by Bend Barks and Rec.
If the dog causes any harm or damage to Bend Barks and Rec's equipment, property, or any person, the Client agrees to pay the full amount of damages incurred as a result of the dog’s actions.
6. Emergency Procedures
In the event of an emergency or injury to the dog, the Client authorizes Bend Barks and Rec to seek immediate veterinary care or medical treatment for their dog. The Client agrees to cover all related costs, including emergency treatment or transportation.
7. Cancellations and Rescheduling
The Client understands and agrees to the cancellation policy, which may require advance notice for cancellations or rescheduling of appointments to avoid any charges or penalties.
Bend Barks and Rec reserves the right to cancel or reschedule services if deemed necessary due to weather conditions, safety concerns, or any other factors that could affect the well-being of the dog or the staff.
8. Photographs and Testimonials
The Client agrees that Bend Barks and Rec may use photographs, videos, and testimonials featuring their dog for promotional purposes, including but not limited to social media, websites, and marketing materials. The Client can opt out of this if desired by notifying Bend Barks and Rec.
9. Governing Law
This agreement shall be governed by the laws of the state of Oregon, and any disputes arising from it will be handled in the courts of Deschutes County, Oregon.
By clicking "Yes," you confirm that you have read, understood, and agree to the terms and conditions stated above. You also affirm that your dog has been examined by a veterinarian and is fit to participate in physical activities provided by Bend Barks and Rec.
